Terms & Conditions

1. Overview

This Agreement applies to all MyBuilder products — including custom websites, software tools, hosted automation systems, and AI services — whether purchased directly or through a subscription.

Each project or subscription may have additional details outlined in a proposal, quote, or order form (an "Order Form").

2. Definitions

Authorized Devices

Computers or mobile devices you use to access our Services.

Content

Any data, code, text, images, or materials you upload or create using our Services.

Documentation

Guides or support materials provided by MyBuilder explaining how to use the Services.

User

Anyone authorized by you to access your account (employees, contractors, or representatives).

Order Form

A signed quote, proposal, or agreement outlining the Services you're subscribing to.

3. Access & License

MyBuilder grants you a non-exclusive, non-transferable license to use our Services for your business during the term of your subscription.

You may install any MyBuilder desktop or mobile apps on Authorized Devices for business use only.

You agree not to:

  • Reverse engineer or modify our software,
  • Use it to build a competing product,
  • Share or resell your account access without our consent.

4. Customer Responsibilities

You are responsible for:

  • Keeping login credentials secure,
  • Ensuring your Users follow this Agreement,
  • Maintaining your own device security and backups.

You are also responsible for the accuracy of all content you upload or publish through our Services.

5. Ownership

All intellectual property in the Services remains the exclusive property of MyBuilder.

You own your own content and data. By using the Services, you grant MyBuilder a limited license to host, back up, and display your content as needed to operate the Services.

6. Payment & Fees

Pricing and billing terms are outlined in your Order Form or online checkout.

Unless otherwise stated, all fees are billed monthly and are non-refundable.

Subscriptions automatically renew unless cancelled in writing before the next billing cycle.

7. Support

MyBuilder provides reasonable technical and customer support via email or chat during regular business hours.

Support for third-party integrations is provided on a best-effort basis.

8. Confidentiality

Both parties agree to keep each other's non-public information confidential and to use it only as necessary to fulfill this Agreement.

9. Data & Privacy

MyBuilder handles customer data in accordance with its Privacy Policy.

We do not sell, trade, or share your personal or business information without consent.

10. Service Modifications

We may update or improve the Services from time to time, including adding or removing features.

If a change materially impacts your use of the Services, we'll provide advance notice.

11. Term & Termination

This Agreement begins on the Effective Date and continues until terminated.

Either party may terminate this Agreement with written notice if the other party materially breaches it and fails to remedy the issue within 15 days.

Upon termination, your access to the Services will be disabled, but you may request an export of your content within 30 days.

12. Limitation of Liability

To the maximum extent permitted by law:

  • MyBuilder is not liable for indirect, incidental, or consequential damages.
  • Our total liability is limited to the amount you paid us in the 6 months preceding the claim.

13. Amendments

We may update these Terms periodically. Any updates will be posted on our website with a new "Effective Date."

Continued use of the Services means you accept the revised Terms.

14. Governing Law

This Agreement is governed by the laws of Alberta, Canada, without regard to conflict of law principles.
